These terms apply to your use of the Actiiv app. When you download Actiiv from the App Store, Apple's standard Licensed Application End User License Agreement also applies. If the two conflict, Apple's agreement decides matters it covers, such as the licence, refunds and payments.

Health and safety notice

Actiiv gives general wellness and exercise suggestions. It is not a medical device, and it does not give medical advice, diagnose, treat or prevent any condition.

Availability and changes

We work to keep Actiiv running well but cannot promise it will always be available or error-free. Features may change over time. Some features need a recent version of iOS or watchOS and may need permissions you can grant or withdraw in iOS Settings.

Limits on our responsibility

Exercise carries some risk. To the fullest extent the law allows, Actiiv and its developer are not liable for injury, loss or damage arising from your use of the app or from following its suggestions, except where the law does not allow us to exclude liability, for example for death or personal injury caused by our negligence, or fraud. Nothing here limits rights you have as a consumer that cannot be limited by contract.

Changes to these terms

We may update these terms. The date above shows when they last changed. Continuing to use the app after a change means you accept the new terms.
